宪法明确指定一个组织是领导集团本身是违反先宪法自己的   中国很搞怪。   形式逻辑可以不讲。   搞神秘主义的实质逻辑。   宪法可以确定国教,主义,或者意识形态,或其他任何准则。   但如果宪法确定一个组织是该意识形态的指定合法代表,就会出问题。   就如同党章可以指定领导人的标准,但不能指定某某人是接班人。   考大学,你只能指定分数线,不能指定录取某某人,某某班级,某某地区。   因为你的主义自身是反对这种封建集权(包括其他任何集权)和形式的,本来就是讲实质逻辑的。   也就是说,无论叫啥名,只要是实质满足条件,就可以成为其合法代表的。   作为一个法律,是要穷尽全部分支的,你别搞到最后,你的法律死机了。   这个组织自身如果不符合这个主义,还如何办?   死机?   不过,有人会说,那时宪法的序言,正文中并未明确。   序言,有法律效力么?   可以有,也可以无。   俺是搞不清。   俺不知,这样的笑话,是不是要演个千秋万代?   总不会,留给我们的子孙除了原子弹,就是一部笑话史吧?   鲍仙还多一样,就是罐头。

原理探讨和实际可能是要分开的   Me: 不要只记住薛定谔,忘了海森堡,忘了矩阵力学   我说镜子这回在耍赖。   镜子: 根本不是“在耍赖”。“先把波函数变回n=1,随便跑,再变n=2,就穿过去”的说法,可以有粒子集团(或时间序列)的统计性来保障。   Me: 但你在这个问题上,是不能用的。   你这样发挥“量子精神”等同于啥事都是可能的,不需要理由。   也就是说,实际发生的,原理性探讨,你还得分开。   你要不分开,啥都不需要理由。    这句话还是对,量子力学如果不修炼到随便扯的境界,就真的没学成。    镜仙都如此,况凡人呼?    相对论和量子力学就是危险的实用工具,很多时候,人们分不清自己是在闲扯,还是在求一个可靠地结果。    正是这个原因,这两大东东,确实需要从根儿废掉,连牛顿一起废掉。   用张树风的话,强拆?

请人为期刊审稿,宜晓之以“利”

先说一段寓言故事:话说一个农夫决定砍掉田边的三个灌木丛,树上的蜂巢也将随之“殉葬”。在他准备砍第一个灌木丛时,蜜蜂苦苦哀求道:“ 善良的主人,请您看在我们每天为您的庄稼传粉的份上,饶了我们吧 ”!农夫心想蜜蜂多着哩,谁都会传粉!于是,他就把这个灌木丛砍掉了! 在他准备砍第二个灌木丛时,蜜蜂怒气冲冲地说道:“ 残暴的主人,你敢毁坏我们的家园,我们决不放过你 ”!农夫被蜜蜂蛰了好几个大包,一怒之下放火把这个灌木丛烧掉了! 在他准备砍第三个灌木丛时,蜂王平心静气地说道:“ 睿智的主人,蜂巢可产很多蜂蜜和蜂王浆,灌木的木质又很细腻,说不定是您的滚滚财源哩 ”!农夫听罢觉得有利可图,于是放下手中的斧头不砍了,他决定与蜂王合作做蜂蜜生意,结果发了财! 这个故事说明, 在寻求合作时,只是一味恳求,可能让对方无动于衷;若抱着对抗心态,很容易两败俱伤;只有让对方意识到,合作将是互利的,他才会心甘情愿进行合作。 下面就以“蜂王姿态”展开本文的主题:请人为期刊义务审稿,光晓之以理还不够,宜晓之以“利”! 除Nature集团系列期刊等“牛刊”有自己的专职“内审”队伍外, 绝大多数学术期刊都是依靠“散兵游勇”进行“外审”, 也就是邀请分散在世界各地的专业领域的同行专家义务审稿,他们一方面可能来自作者的推荐,另一方面可能来自编辑部建立的资料库。 我曾多次收到国外期刊的审稿邀请,最初本着向别人学习的姿态,基本上是来者不拒,但后来审稿多了,就有点麻木,特别是遇到自己工作任务较重时,也曾拒绝过几次。不过, 想起人家激励评审的“高招”——给点“甜头”,还是印象十分深刻! 记得给Springer旗下期刊审稿,编辑部许诺评审人可以在Springer优惠购书,好像是七折。如果评审人想买一大推书,尤其是大部头的,这个折扣还是很有诱惑力的! 刚收到另一份期刊的审稿邀请信,编辑一开始就晓之以“利”: 如果接受审稿,就能免费使用SCOPUS一个月!请看: To assist you in the reviewing process, I am delighted to offer you full access to Scopus* for 30 days. With Scopus you can search for related articles, references and papers by the same author. You may also use Scopus for your own purposes at any time during the 30-day period. Access instructions will follow once you have accepted this invitation to review. 对于可以自由进入SCOPUS网站的审稿人来说,这点“蝇头小利”算不上什么,但我刚好不能免费使用SCOPUS,不如利用这个机会见识一下。说实话,最近因为忙于评审NSFC申请书,时间紧,任务重,不是看到这点“甜头”还真的会拒绝! 不曾想到,编辑部的这一招弄得我欲罢不能,看来只能挑灯奋战了! 反观国内一些专业杂志,“功课”就做得很不够!且不说想方设法给审稿人一点好处,连一条顺畅的编审往来都不具备,怎么能让评审人为它免费服务? 比如,有家杂志邀请我审稿,因为专业跨度太大,我回信明确表示拒审。但是,不知编辑部没收到我的回信还是什么其他原因,遂于近日再来一信催问审稿进度,说稿件评审截止日期已到,问我是否审完!他这么一问,反倒让我产生负罪感! 可是,来信中却赫然写明下面两行字: 如果您因故不能处理, 请点击" 我不接收审稿邀请 ",我们将请其他审稿人进行审理。 如果您同意受理, 请点击" 我同意审稿 "。 按理来说, 编辑部在第一封邀请信中就应该明确写明上面两行字,以便审稿人及时反馈意见。但既没有给审稿人选择的余地,也没说明审稿的期限。 由于专业不合,现在我依然拒审。可是,不管你何时点击“我不接受审稿邀请”,都是一个“死链接”,那个服务系统也太糟糕了! 看来, 国内学术期刊落后还不仅仅是办刊观念落后,而且服务意识落后、网络技术落后、工作方法落后,根本没有人性化方面的考虑! 难怪国内学术期刊经常找不到愿意审稿的专家,除了专家本身的原因,编辑部是否也应该扪心自问呢? 人人工作都很忙,只能在时间、精力允许的前提下为有限的期刊进行有限的义务审稿,不可能对所有审稿需求都来者不拒。既然是义务审稿,就必须让审稿人有愿意接受审稿的理由,或者动之以情,或者晓之以“利”!如果什么“功课”都不做,什么“点子”都不想,那就只能等“瞎猫碰上死老鼠”了!

抓紧把水的事情办好吧,不然我们目前的“财富”“设施”都将是过眼烟云;30年前毛主席说:"水利是农业的命脉",30年后胡主席说:"水利是国家的命脉"。我国目前的能源利益集团对水电的无度开发已经严重破坏了水资源的分配格局,任其随意发展中央一号文件很难得落实,我们的发展也因水而停滞或倒退。

五大电力集团近日陆续在年度工作会议上披露自己业绩。除大唐亏损1.1亿元外,华能、国电、中电投、华电4家按盈利水平分列一至四席,净利润分别为42亿元、37.5亿元、33.89亿元和17.5亿元。在去年煤价高位运行的不利局面下,电力集团能扭亏为盈,非火电业务功不可没。   难以落实的煤电联动机制早已让五大电力叫苦不迭。为了分摊火电带来的大幅亏损,五大电力纷纷涉足非火电业务,努力削减火电资产份额。近年来,上游煤炭采掘、金融、水电、风电等都成了电力集团的“香饽饽”。   不过中电投集团公司总经理陆启洲认为,火电亏损仍将是较长时间所面临的重大问题。陆启洲表示:“燃料价格持续上涨,受制于通胀压力,煤电价格体系短期内难以理顺,电力体制改革停滞不前,火电亏损仍将是我们在较长时间内面临的重大问题。”不难看出,未来大型电力的非火电业务方向仍将继续深化。

强盗、土匪、军阀和各种暴力集团靠什么生活?靠血酬。血酬是对暴力的酬报,就好比工资是对劳动的酬报、利息是对资本的酬报、地租是对土地的酬报。不过,暴力不直接参与价值创造,血酬的价值,决定于拼争目标的价值。如果暴力的施加对象是人,譬如绑票,其价值则取决于当事人避祸免害的意愿和财力。这就是血酬定律。在此过程中,人们的核心计算是:为了一定数量的生存资源,可以冒多大的伤亡风险,可以把自身这个资源需求者损害到什么程度。这个道理说来简单,却能推出许多惊人的结论,解释许多费解的历史现象. 现象之一:土匪种地 明朝正德十二年(1517年)农历七月初五,南、赣巡抚王阳明向皇帝上疏,报告江西剿匪的战果,疏中提到了山贼的日常生活。王阳明说,各贼探知官府练兵,准备进剿的消息后,“将家属妇女什物俱各寄屯山寨林木茂密之处,其精壮贼徒,昼则下山耕作,夜则各遁山寨。”读到这句话的时候,我始而惊讶,继而奇怪:土匪也种地?土匪为什么要种地?我想象出一个渐变系列:一端是专业土匪,一端是专业农民,两者之间存在着众多组合,生产与抢劫的组合:以抢劫为生的土匪渐渐变成以耕种为生的农民。那么,决定这种比例关系的,究竟是什么东西? 现象之二:土匪保民 1922年,美籍牧师安东·伦丁遭河南土匪绑票,获释后,伦丁牧师写下了关于土匪的见闻:还在商酒务的时候,有一天,一片浓重的阴郁笼罩了匪首和整个营地。匪首的一个下属违反了命令。在土匪地盘里,有些做法与在行军路上有所不同。在路上,任何土匪都可干下几乎任何暴行而不会因此受罚。而在这里,在土匪地盘里,匪首们是很注重自己名声的。 正在受审的这个土匪以匪首的名义偷取了一条毯子。当消息传到匪首耳朵里时,他暴跳如雷,命令马上把这个该死的土匪宰了。 这 个土匪的许多朋友为此都来求见,希望他宽大处理,但所有这些努力都没有奏效。 人被枪毙了,一切都已过去,但处决的命令却令人耿耿于怀。好几天里,营地里人气低落消沉。尤其是匪首自己,更是明显的郁郁寡欢。 伦丁牧师对土匪执法的描述很真切。可以看出,在自己的地盘里,土匪比警察还要严厉地打击犯罪。我又想象出另一个渐变系列:一端是纯粹的害民贼,另一端是纯粹的保民官,两者之间存在着众多组合,保护和加害的组合。那么,决定这种组合的,到底是什么东西? 最大化追求 无论是保民还是害民,暴力集团都在追求血酬的最大化。(明)顾山贞在《客滇述》中记载:崇祯七年(1634年),张献忠为官军所败,从四川仪陇奔回陕西,一部分人留在山里继续当土匪。这些土匪以通江、达州、巴州为巢穴,“掳掠人口,则责人取赎。当播种时,则敛兵暂退,及收成后则复来。以为人不耕种,则无从而掠也。”这段话说得很明白:土匪之所以不打扰农民耕种,是为了有的可抢。抢劫行为存在的前提,是有可抢的东西;绑架人质勒索赎金的前提,是人质有支付赎金的财力。如血酬定律所说,人质的命价,是由当事人支付赎金的意愿和能力决定的。在风险和成本相同的条件下,人质越有钱,抢劫对象越富裕,绑票和抢劫的收益越高。反过来说,抢劫绑票的对象越穷,抢劫的收益越低。低到得不偿失的程度,土匪就没法干了。根据这个道理,我们可以依据血酬定律做出五个方向的推想。 第一推想:匪变官 第一推想:为了追求血酬的长期最大化,土匪愿意建立保护掠夺对象的秩序。侯少煊是著名的四川袍哥大爷,与土匪头子往来密切。他在《广汉匪世界时期的军军匪匪》3中写道:广汉位居川陕大道,商旅往来,素极频繁。但1913年以后,时通时阻,1917年以后,几乎经常不通。不但商旅通过,需要绕道或托有力量的袍哥土匪头子出名片信件交涉,即小部军队通过,也要派人沿途先办交涉,否则就要挨打被吃。后来匪头们认为道路无人通行,等于自绝财源,于是彼此商定一个办法,由他们分段各收保险费,让行人持他们的路票通行。例如一挑盐收保险费五角,一个徒手或包袱客收一元。布贩、丝帮看货议费,多者百元,少者几元、几十元不等。……匪头们鉴于普遍造成无人耕田和人口减少的现象,会断了他们以后的饭碗,于是也兴起一套“新办法”,用抽保险费来代替普遍抢劫。即每乡每保每月与当地大匪头共缴保险费若干元,即由这个匪头负责保护,如有劫案发生,由他们清追惩办。外地匪来抢劫,由他们派匪去打匪。保险费的筹收办法,各乡不一。北区六场和东区连山、金鱼等场,是规定农民有耕牛一只,月缴五角;养猪一只,月缴三角;种稻一亩,秋收后缴谷一斗;地主运租谷进城,每石缴银五角……如此等等。这样一来,有些乡镇农民又部分地开始从事生产,逃亡开始减少,匪徒们坐享收益,没有抢劫的麻烦,多少也有点好处。但是他们的欲望是没有止境的,钱财越多越好,人枪也是越多越好。这种分乡分片自收保险费的办法,总对他们有了限制,他们当然不能满足。所以有些出了保险费的地区,仍有抢劫事件发生。地方首人(当然是袍哥大爷)去报知大匪头,匪头只推说某些兄弟伙不听话,答应清查。有时也把兄弟伙“毛”(引者注:即杀掉)几个做个样子,以表示他们的“信用”。 我不清楚当时当地的物价水平,仅仅从田租或土地税的角度看,“种稻一亩,秋收后缴谷一斗”,土匪制订的税率在5%~10%之间,大有什一而税的儒家之风。这笔钱该如何定性呢?从来源看,这是对抢劫的替代,可以看作血酬。从形态看,如果把暴力集团建立并维护的制度看作“法”的萌芽,血酬便体现为制度收益,或曰“法酬”。从功能看,土匪收费之后,承担了维持治安、抗击外匪的责任,有时还杀几个违法的本伙兄弟以示信用,这笔钱又有点公共税收的意思。那么,土匪征收的这笔钱到底是什么东西?我以为,这笔钱是由两部分构成的。一部分是公共税收,或曰公共产品的价值,譬如维持治安的费用。另一部分是法酬——血酬的存在形态之一,即超过公共产品价值的多收部分。以简明的公式表达:全部税费=公共产品价值+法酬(血酬)。将此公式倒过来,则得出法酬的定义:法酬=全部税费-公共产品价值。这个公式不仅适用于土匪世界,也适用于皇家帝国。帝国的全部税费,扣除公共产品的价值之后,剩余部分便是法酬。 举个例子说,尽管我们不知道中国老百姓肯花多少钱雇一个皇帝,但我们知道美国人民以20万美元的年薪雇了总统克林顿,俄国人民以3。3万美元的年薪雇了总统普京,而中国皇帝,譬如颇为节俭的崇祯和他的皇后,仅仅两个人吃到肚子里的日常伙食费,每年就有16872两白银,按粮价折算超过52万美元。中国的工资和物价水平比较接近俄国,就算普京总统一家的伙食开支占了总收入的30%,每年吃掉1万美元(8。3万人民币),崇祯夫妇(不算儿女和众妃子)吃掉的竟是人家的52倍。依此而论,普京家吃掉的1万美元可以看作人民愿意支付的第一家庭伙食费,视为合理的公共开支,而崇祯夫妇多吃的51万美元,就要视为法酬了。 所谓公共产品的价值,在土匪世界和帝国时代,只能根据“影子价格”——民主财政体制下的公共开支——估算一个大概。维护公共安全和兴修水利道路桥梁总是要花钱的,也是民众需要的。作为公共服务的提供者,官员们的工资也是应得的。皇帝或总统的工作复杂,责任重大,当然还应该享有高收入。不过,皇帝比总统多吃51倍,这笔开支实在无法从公共产品价值的角度去解释。即使不谈民主财政,作为大老板,明朝皇帝给自己最高级雇员一品文官开的俸禄,每年也不过1044石大米,约折2。2万美元。考虑到免税因素,与普京总统的年薪相差不远,相当于崇祯夫妇半个月的伙食费。 所谓法酬,在帝国制度中由两部分构成,一是皇家和贵族的“工资外”收入,即崇祯比普京或克林顿多出来的收入;二是官吏们通过 潜规则 攫取的收入。皇家和贵族的“工资外”收入类似股东收益,那是他们或他们的祖先流血牺牲打天下换来的。官吏的潜规则收入近似代理人的额外收益,那是在行使代理权的过程中私下交易所得,这种灰色收入虽然不那么合法,但这笔账却不能不算在皇帝头上。皇家贵族为了维护有利于自身利益的秩序,为了保护法酬,减轻工作负担,不能不雇佣代理人,也不得不容忍代理人作弊,容忍他们建立的潜规则体系。消除潜规则的最有效的方式,就是允许受害者监督控制官吏,而让羊群监督甚至控制牧羊犬是很危险的,是可能导致变天的。正如老子和韩非所说,官爵赏罚和军队一样,乃“国之利器,不可以示人”。为了保证血染江山永不变色,控制权一定要牢牢掌握在牧主手中,哪怕潜规则泛滥为滔天洪水。 我们还是接着说第一推想。这个推想也可以解释李自成的变化。最初,李自成在“流寇主义”时期,一路烧杀抢掠。《明史纪事本末》说:“初,自成流劫秦、晋、楚、豫,攻剽半天下,然志乐狗盗,所至焚荡屠夷。”后来,连打了几个大胜仗,李自成“席卷河南,有众百万,始侈然以为天下莫与争,”觉得自己可能得天下了,便把江山看作自己的地盘。于是行为大变。“城下,贼秋毫无犯。自成下令曰:杀一人者如杀我父,淫一人者如淫我母。”李自成到底是流贼头目呢,还是仁义之师的领袖呢?这个问题不好答。事实上,李自成一直是暴力集团的好领导。作为暴力集团头子,李自成始终在追求血酬的最大化。流贼烧杀抢掠,追求一次性血酬的最大化;进城后秋毫无犯,追求打天下坐江山的长期法酬的最大化。 第二推想:官变匪 第二推想与第一推想的方向相反:为了追求短期血酬收入的最大化,合法的暴力集团也可以退化为土匪。 1918年,熊克武出任四川督军,召开整军会议,确立了各派系军队“就防划饷”的防区制。用大军阀刘文辉的说法:“当年四川军人控制的防区都是独立王国,在经济上予取予求,为所欲为,所以大家都拼命地争城争地。四川军阀混战16年,大多为此。”刘文辉用了“独立王国”一词。当时四川的局面颇像战国时代,六七个暴力集团的首领在这片土地上合纵连横,群雄争霸。每个军阀都有权在自己的防区内设立制度、任命官吏、征收赋税,不经该防区的军阀认可,中央政府的法令也不能生效。不过,由于争夺激烈,防区主人频繁变换,稳定程度比不上独立王国,也比不上诸侯领地,倒有些像黑帮地盘。刘文辉说,他“在自己的防区内,苛捐杂税,人有我有,竭泽而渔,不恤民困,……有一个时期,在无可如何之中,竟至从鸦片中去增加收入。”军阀陈光藻说:“军费一般是靠征收田赋,正税不足,便行预征,有一年预征五六年粮赋的。到1935年(民国二十四年)时,有些地方预征田赋已到民国一百多年的。除了预征田赋就是普种鸦片,征收烟款,便设烟馆,抽收红灯捐。各军防区还设立水陆关卡,征收过道捐税。”除了预征之外,竭泽而渔的具体办法还有田赋附加。据1934年对四川15个县的调查,田赋附加税有学费、县志、被服、备丁等26种名目,附加税额之沉重,到防区制末期,竟有达正供数十倍者。这些军阀的行为与土匪有什么区别呢?与同时同地的土匪比较,军阀的搜刮似乎更加凶恶。土匪毕竟没有“预征”,也没有“附加”,惟恐竭泽而渔,断了日后的财路。而军阀恰恰追求“竭泽而渔”。这不是道德和名分问题,而是利害的施报问题。既然防区经常易手,实施杀鸡取蛋的政策,恶果未必由自己承担,眼下还可以壮大力量。实施养鸡生蛋的政策,将来未必吃得上蛋,鸡也可能让人家抢去吃了,眼下的营养不良又可能迅速导致溃败。在这种格局中,竭泽而渔——标准的流寇行径——便是最有利的选择。

打造中国自己的学术期刊出版“航母”浅议

关于中国目前学术期刊出版的现状、存在问题和发展,在王志明老师发起的学术期刊博文大赛期间已经有很多博主在博文中表达了看法。我前几天忙着生病、上课、改稿和审稿,只抽空理了一下思绪,一直没有动手,今天稍有闲暇,赶紧把自己的一些想法用博文的形式写出来。我的这篇博文起了一个不符合我自己一贯风格的略显张扬的题目打造中国的学术期刊航母浅议。 之所以要说打造中国的学术期刊航母,是因为我们国内的学术期刊出版行业从规模上讲其实很庞大,但远远不够强大,就如中国的海军,舰艇的数目不少,近海防御能力很强,却没有远洋作战能力,原因就在于缺乏现代海战中必须的大吨位主力战舰航空母舰。为了真正把中国的学术期刊出版业做强,需要考虑打造中国自己的学术期刊航母,这不但应该是一个中国学术期刊出版业发展的长远目标,也是实现中国科学技术长期持续发展并提升其国际地位的必要条件之一。 为了打造中国的学术期刊出版航母,自然需要我们实实在在地做些事情,需要在完成一系列的短期任务的基础上,通过一点一滴的工作积累达到这个长远目标。目前,品质高的学术期刊正在逐渐投靠国外大的出版集团,中国出版业被国际出版大鳄们瓜分蚕食并形成其各自势力范围的局面正在形成,在这种情况下提出打造中国自己的学术期刊出版航母的观点似乎很不合时宜,但若此时仍不提,将来恐更无机会,所以我们首先必须要亮明观点,并开始说服国家制定一个长远的规划,并采取一些行动。 目前中国的期刊数量很多、由于最近这些年科研事业的蓬勃发展和发表需求,可利用的资源(包括经费、从业人员和稿源)已经很多,规模和数量似乎早已不成问题,急需解决的主要是观念和水平的问题。以往的期刊多挂靠在具体的单位,包括各研究所、大学以及一些企业,其兴旺与否很大程度上决定于挂靠单位的经济效益、管理模式、价值取向及其对期刊的态度等,期刊的编辑队伍也因此显得参差不齐,在这种情况下国际竞争力自然极其有限。如果要提升中国学术期刊出版的水平,最好能由国家新闻出版署出台政策,整合已有的优势资源,成立依托国家科技部、教育部、自然科学基金委和中国科学院等部委级单位的若干大型学术期刊出版集团,部分使用这些大部委的经费,部分依靠出版发行和广告类的收入,形成对出版集团比较稳定的经济支撑和政策保障。形成出版集团后,按照较高的标准,组织建立编审队伍,通过在全球范围吸纳人才和组织优秀论文(包括安排文字语法修改)在主要期刊的英文版上发表,逐步提升期刊的国际化水平。 先提出以上一些粗浅设想,希望和广大博友们讨论。
